Seventeenth Judicial District Compliance Plan for CJD 05-03

The Seventeenth Judicial District Compliance Plan for CJD 05-03 has prioritized the preparation of transcripts and set forth certain requirements for the setting of hearings to facilitate the preparation of transcripts for use in subsequent proceedings.  The priorities for court reporting by stenographic court reporters is in a descending order as follows:

  • Criminal Trials;
  • Criminal Morning Docket;
  • Termination of Parental Rights Hearings in Dependency and Neglect cases;
  • Delinquency Trials;
  • Other Dependency and Neglect Hearings;
  • Civil Trials;
  • Mental Health Hearings;
  • Contested Permanent Orders involving Children in Domestic Relations and Paternity Cases;
  • Probate Hearings; and
  • Other Domestic Relations Cases

The preparation of transcripts will also be prioritized by statutory or appellate rule considerations.  Cases with statutory priority shall receive equivalent priorities for transcript preparation.  Counsel should set hearings to insure that a transcript will be available for use at trial.  Where possible counsel should allow at least sixty (60) days for transcript preparation.  No less than thirty (30) days should be permitted for the preparation of a transcription of proceedings.

In juvenile delinquency matters where there is a speedy trial requirement of sixty (60) days, counsel will be expected to file their motions and set their hearings with at least thirty (30) days for the preparation of transcripts prior to the trial.  Failure to promptly file and set motions with sufficient time to procure a transcript for trial will not constitute good cause for a continuance and may be construed as a waiver of the right to a transcript.

A summary of the Seventeenth Judicial District Compliance Plan sets forth more specifics of the plan.
